Basically because he sent them privately, the rules state, that he can't be punished

I don't think this is a ruling that would do him any favours. Get a 12 month suspension and serve it and many people will think he has been punished and it is time to move on. This judgement would just leave all prospective employers with the decision of deciding for themselves how long is enough or taking the gambnlr of hiring him almost straight away.

I think a lot of clubs might feel they don't want to be the first one to make that decision.
